Welcome to BizCart. These Terms of Service ("Terms") govern your access to and use of bizcart.com and related services (the "Service"), operated by BizCart ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms.
1. The Service
BizCart is an online marketplace where users can buy a business, sell a business, or start a business by launching their own storefront. BizCart provides the platform that connects buyers and sellers; we are not a party to, and are not responsible for, any transaction between users.
2. Eligibility & Accounts
You must be at least 18 years old to use the Service. Browsing and listing are available without forcing you to create an account up front, but certain features require an account. You are responsible for the accuracy of your information and for maintaining the security of your account credentials.
3. Listings, Verification & Fees
- Listing a business is free for asking prices under $100,000. Listings are activated once the associated email address is verified.
- Listings with an asking price over $100,000 require a paid Premium membership; a successful payment serves as verification for those listings.
- Premium membership is $99 per month, billed monthly until cancelled, and includes unlimited postings plus featured top placement. There is no one-time fee — membership is always a recurring monthly subscription. Payment questions can be sent to [enable JavaScript to view email].
4. User Content
You retain ownership of the content you post, but you grant BizCart a non-exclusive, worldwide license to host, display, and distribute it as needed to operate the Service. You are solely responsible for your content and represent that you have the rights to post it and that it is accurate and lawful.
5. Acceptable Use
You agree not to use the Service to post false, misleading, fraudulent, infringing, or unlawful content; to post spam or illegitimate claims; to harass others; or to attempt to disrupt or gain unauthorized access to the Service. We may remove content and suspend or deactivate accounts that violate these Terms.
6. Storefronts
Storefronts are free to create. A Premium membership unlocks additional features such as a custom theme color, a higher product limit, and top placement. You are responsible for the content and conduct of your storefront.
7. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee the accuracy of listings, the conduct of users, or the outcome of any transaction. You use the Service at your own risk.
8. Limitation of Liability
To the fullest extent permitted by law, BizCart will not be liable for any indirect, incidental, special, or consequential damages, or for any loss arising from transactions between users, arising out of or relating to your use of the Service.
9. Termination
We may suspend or terminate your access to the Service at any time for conduct that violates these Terms or that we reasonably believe is harmful to other users or to BizCart.
10. Changes to These Terms
We may update these Terms from time to time. Material changes will be reflected by updating the date above, and your continued use of the Service constitutes acceptance of the revised Terms.
